SAP Referral Compliance
Any employer required to comply with Department of Transportation (DOT) regulations must provide an individual who has tested positive for drugs or alcohol on a pre-employment, random, reasonable suspicion or post accident test with a list of qualified SAPs (Substance Abuse Professionals) regardless of whether or not that individual is terminated. Per 49 CFR Part 40, Subpart O, this responsibility may be deferred to a qualified Service Agent such as ASAP. Acting as the Service Agent for your company, ASAP will provide professional SAP compliance services for referred individuals.
DOT-Mandated & Non-Mandated Case Management
The ASAP 'signature' SAP Evaluation and Case Management services allow your company to maximize the return on your compliance investment. Case management services include: SAP Referral Intake; SAP Coordination of Initial Evaluation Appointment Time; Procedural Review of Initial SAP Recommendations; Assistance in Connecting Employee to Treatment and/or Education Program(s); Monitoring Employee in Treatment and/or Education Program(s); SAP Coordination of Follow-up Appointment Time; Procedural Review of Aftercare Recommendation(s); Ensure SAP Mails Initial and Follow-Up Reports to DER; Case Closure Memo. Return-to-Duty Conferencing
ASAP facilitates return-to-duty conference calls to review an employee's aftercare requirements and follow-up testing plan procedure. Once an employee has demonstrated compliance with treatment and/or education requirements and completes the follow-up SAP evaluation, the employer must send the employee for a return-to-duty drug and/or alcohol screen. Provided the results are negative, ASAP will supply your company with a designated conference call number and will coordinate a date and time for the call with the DER, the employees direct supervisor, and the employee. During the conference call, an ASAP representative will lead a review of the employee's initial treatment and/or education recommendations and any additional aftercare treatment and/or education requirements, made by the SAP. The call is approximately 30 minutes.
Aftercare Program Compliance Services
ASAP offers continuing compliance monitoring services to employers when the SAP believes the employee needs additional treatment, aftercare, or support group services, even after the employee returns to safety-sensitive duties per DOT regulation 49 CFR Part 40.303. ASAP provides compliance monitoring of completion of treatment/education, all continuing care recommendations, the complete Follow-Up Testing Program, documentation and reporting violations, case review, documentation and reporting of program completion and complete paper trail maintenance for up to five years following the employee's return to safety-sensitive duty.
